The following terms and conditions fully comply with the provisions of Law 18.829, Decree 2182/72, and Resolution 404/72.

General Booking Conditions
- You will make your reservation with Mallku Expediciones, a Travel and Tourism Company, Registry No. 13.424, with its registered office at Perú 1499, Mendoza City, Argentina, managed by Mr. Víctor Hugo Herrera.
- The terms and conditions of all agreements made with Mallku Expediciones will be subject to Argentine laws.
- By making an effective reservation, you acknowledge that you have read, understood, and accepted all these “General Booking Conditions” and agree to abide by them.
- Mallku Expediciones is not responsible for decisions made by the Government of Mendoza or the National Argentine State, or any of its decentralized agencies, which could alter or prevent the execution of a specific expedition or service.
- Reservations must be made via the Mallku Expediciones email address or at the office previously mentioned.
- Once the reservation has been accepted by Mallku Expediciones, you must make a deposit of 20% of the total cost of the services to be contracted. This deposit can be made once the company sends you the details of our bank account via email.
- After completing this transaction, Mallku Expediciones will send you a reservation confirmation by email, along with additional useful information, such as the hotel where you will be staying, contact phone numbers, and other relevant details.
- The remaining balance must be paid once the participants are in the city of Mendoza and before the start of the contracted services.
- The prices indicated in the quotes received by the client are expressed in U.S. dollars and are subject to changes without prior notice. The passenger will pay the rate in effect at the time the reservation request is accepted. The price will only be fixed and unchangeable by making the full payment for the trip (in cash) when booking. Otherwise, the company reserves the right to modify the final price of the program without prior notice. These changes will occur due to market fluctuations affecting cost composition. Any price increase must be paid before the start of the trip without exception.
- Mallku Expediciones will honor the itinerary or reservation and coordination of your service. However, unforeseen and unfavorable situations may arise, such as earthquakes, strikes, social unrest, adverse weather conditions, epidemics, poor road conditions, or fires. Mallku Expediciones will not assume any responsibility for the aforementioned reasons or any other circumstances beyond its control.
- Once you contract the service of Mallku Expediciones, you authorize the guide to act as the leader and director of the program, delegating decision-making to him for the group’s safety and well-being. If the guide decides that a participant must leave the expedition, whether due to health factors, improper actions, or inappropriate behavior that puts the group’s safety, the environment, or current laws at risk, this person must leave the expedition and will not receive any reimbursement.
- If any participant decides to abandon the expedition for any reason before it is completed, they will not be entitled to any refund. Any expenses incurred due to leaving the expedition will be the sole responsibility of the client.
- If the group cannot complete its expedition due to unfavorable weather conditions, Mallku Expediciones will not refund any money.
- If a client encounters missing documentation, a passport not in order, or delays or losses of luggage that make it difficult to enter the country, all the expenses arising from such issues will be the sole responsibility of the passenger.
- In this type of trip, the passenger will be exposed to certain risks, such as frostbite, avalanches, rockfalls, storms, or risks of being kicked or trampled by an animal. Mallku Expediciones will not be held responsible in any of these cases. Therefore, we recommend our clients take these incidents into account when beginning an expedition and when purchasing travel insurance.
- Mallku Expediciones does not include personal travel insurance in its programs. Therefore, the company advises passengers to have travel insurance.
- If a participant suffers an injury, illness, or, in extreme cases, death during the expedition, Mallku Expediciones will not assume any responsibility in such cases.
- All luggage and personal effects will be the passenger’s responsibility at all times. In case of loss, accident, or damage to luggage during transportation by vehicles or mules of Mallku Expediciones, the company will compensate with a maximum refund of USD 200.
- Often, due to adverse weather conditions, such as storms or strong winds, the equipment or tents of expedition members may be damaged. Mallku Expediciones will not be held responsible in such cases, and the client will not receive any compensation for the damage.
- The company will fulfill the services that were reserved and listed in the included services section of each program.
- Services not listed in the included services section of each program will not be provided by the company, e.g., extra beverages, tips, phone calls, laundry, recreational or natural park tickets, transportation (taxis or buses), etc., or any other service not specified in the included services.
- When the company acts as an intermediary between the passenger and transport companies, hotels, medical service providers, etc., in case of non-compliance by any of these, the company will make every effort to ensure the effective completion of the trip, such as contracting new providers or withholding payments to non-compliant providers. The company is not responsible for third-party services.
- If, for any reason, passengers do not use certain services, such as hotel nights, transportation, meals, permits, or any other included service, Mallku Expediciones will not refund any amount to compensate for the unused service.
Cancellation and Refund Policy
- If, for any reason, a participant decides to cancel the reservation, they must notify Mallku Expediciones. The cancellation date will be the day the company is officially notified by the client. If the client’s notification is received 30 days before the trip, Mallku Expediciones will refund 30% of the deposit. The cancellation amount in favor of the passenger will be refunded within 30 days from the notification date.
- If the notification is received within 30 days before the trip’s departure, the company will retain the total deposit.
- If Mallku Expediciones is forced to cancel an expedition or service due to force majeure or for any other reason different from those mentioned in the previous point, the company will refund 100% of the deposited amount.
Modification of Terms of Use
Mallku Expediciones reserves the right to modify the presentation and configuration of the website at any time, as well as these Terms and Conditions.
Therefore, Mallku Expediciones recommends that all users read them carefully each time they access the website.
Contractors of any services offered on this website will always have the Terms and Conditions available in a visible place, freely accessible for any inquiries.
If any clause of these Terms and Conditions is declared null, the remaining clauses will remain valid and will be interpreted considering the parties’ intent and the purpose of these Terms and Conditions.
Mallku Expediciones may refrain from exercising some of the rights and powers granted in this document, which will not imply a waiver of those rights unless expressly recognized by Mallku Expediciones or the prescription of the corresponding action.
